Competitive bidding threshold

Public works are procured by competitive sealed bidding under the New Mexico Procurement Code; each public body sets the small-purchase limit below which simplified procedures apply.

Award standard

Contracts go to the lowest responsible bidder.

Multiple-prime contracts

New Mexico has no statewide multiple-prime mandate. Unlike New York's Wicks Law or Pennsylvania's Separations Act, a single general contract is permitted.

Prevailing wage

The Public Works Minimum Wage Act (NMSA §§13-4-10 to 13-4-17) requires prevailing wages on state and local public works over $60,000.1 A 2025 amendment extended coverage to projects financed through municipal or county industrial revenue bonds.

Contractors must hold a valid Labor Enforcement Fund registration with NM Workforce Solutions when bids are due and throughout the project.

Document distribution & addenda

New Mexico DOT §102.7.1 posts addenda and the Chief Engineer's written responses to bidder questions on Bid Express for all bidders; requests must be received at least 72 hours before bid opening, and responses are provided, whenever practicable, no later than 24 hours before bid opening.3

Interpretation requests are due at least 72 hours before bid opening; written responses are posted to Bid Express, whenever practicable, no later than 24 hours before bid opening.

Record of change

2025 Law

New Mexico requires prevailing wage on public works over $60,000 under the Public Works Minimum Wage Act. A 2025 amendment (effective June 20, 2025) extended it to industrial-revenue-bond-financed projects.
